Supreme Court’s Timeline On When One Can File A Presidential Petition
Within seven days of the IEBC’s proclamation of the results, the petition contesting the results must be submitted.
As a result, a candidate who desires to contest the results of the election for president if Wafula Chebukati announces them today must submit a petition before August 22, 2022.
The petitioner must serve the respondent within 24 hours of filing the petition.
Within four days of the respondent being served with the petition, a response must be submitted and served.
A reply must be submitted and served within 24 hours of a petition response.
Within 24 hours of submitting the petition answer, interlocutory applications must be submitted and served.
A response to the interlocutory applications must be submitted and served within 24 hours after the date on which they were filed and served.
Applications from third parties must be submitted and served within 24 hours after submitting a petition response.
After eight days after the petition’s filing date, a pre-trial conference will be held.
The Supreme Court will hold a hearing on the petition just after the pre-trial conference.
14 days after the petition was filed, it will be decided.
