A Petition Has Been Filed Challenging Didmus Barasa’s MP Win
A petition opposing Didmus Barasa’s election as a member of parliament in the Kimilili Constituency was submitted to the Bungoma High Court on Wednesday.
According to a statement signed by Advocates Ongoya and Wambola, who will be the petitioner’s legal counsel, Barasa has been designated as the respondent in the case No. E001 of 2022.
Barasa was additionally admonished by the attorneys to “present within 5 days” to the summons or else the petition will be heard without him.
In the general election on August 9, Barasa won re-election with 26,861 votes, defeating Democratic Action Party of Kenya (DAP-K) nominee Brian Khaemba, who garnered 9,497 votes.
However, he was confronted after being charged with shooting the assistant of his opponent on August 9 night.
After being charged with murder and being brought before the court to enter a plea, Barasa was handed over to the Directorate of Criminal Investigations and freed on a Ksh.10 million bail with a Ksh.5 million surety (DCI).
In addition, he was told not to visit his Bungoma County home or speak to any of the case’s witnesses until after their testimony in court.
The matter is scheduled to be discussed on November 14, 2022.
